Terms of Service

These Terms of Service ("Terms") govern your use of the ChatCaddy Chrome extension, the website at chatcaddy.app, and related services (together, the "Service"). The Service is operated by Eliryn ("we", "us"). By installing the extension, creating an account, or using the Service, you agree to these Terms.

1. The Service

ChatCaddy is a browser extension that organizes the live chat of Whatnot live streams into buyer threads and a queue of unanswered questions, shown in Chrome's side panel. Features may change as we improve the Service.

2. Not affiliated with Whatnot

ChatCaddy is an independent product. It is not affiliated with, endorsed by, or sponsored by Whatnot Inc. "Whatnot" is a trademark of its owner. You are responsible for complying with Whatnot's own terms and policies when you use Whatnot.

3. Accounts

You can use the extension without an account. Some features, including paid plans, require an account. You must provide accurate information, keep your sign-in credentials secure, and be at least 18 years old (or the age of majority where you live). You are responsible for activity under your account.

4. Acceptable use

You agree not to:

• use the Service to break the law or violate anyone's rights;
• attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service;
• resell or redistribute the Service without our written permission;
• use the Service to harass, spam, or collect data about other people beyond what the Service provides.

5. Plans, billing, and cancellation

ChatCaddy offers a free plan and will offer a paid Pro plan billed monthly or yearly. Payments for paid plans are processed by our reseller and merchant of record, Polar (polar.sh), which handles checkout, billing, taxes, and receipts. Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable. If you believe you were charged in error, contact support@chatcaddy.app. We will give advance notice of any price change before it applies to your next renewal.

6. Third-party services and affiliate links

The Service relies on third parties, including Whatnot, Clerk (accounts), Polar (payments), and, if you add an API key, TypeSafe (typesafe.ai) for AI classification. Your use of those services is subject to their terms. Links to Whatnot shown in the extension may be affiliate links, which means we may earn a commission if you make a purchase through them, at no extra cost to you.

7. Your content

Chat content you view with the extension belongs to its authors. We do not claim ownership of it. The extension processes it in your browser to provide the Service, as described in our Privacy Policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Classification of chat messages is automated and may be inaccurate; you remain responsible for responding to your buyers. Changes to Whatnot's website may cause features to stop working without notice.

9. Limitation of liability

To the maximum extent permitted by law, Eliryn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or sales, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or US $50, whichever is greater.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms. When we do, we will change the "Last updated" date above, and for material changes we will notify account holders by email. Continuing to use the Service after changes take effect means you accept them.

12. Governing law

These Terms are governed by the laws of [GOVERNING LAW — TO BE CONFIRMED], without regard to conflict-of-law rules.
